This Privacy Policy describes how Niamh Ventures LLC (referred to as "Niamh," "we," "our," or "us"), a limited liability company organized under the laws of the State of Florida, United States, collects, uses, stores and protects personal information in the course of providing digital infrastructure services to its client companies.

1. Scope of this Policy

Niamh Ventures provides infrastructure services to other businesses, not directly to consumers. When you interact with a system that Niamh operates on behalf of a client — for example, a messaging system, intake form or notification service operating under that client's brand — the client business is the data controller and primary point of contact. Niamh acts as a service provider (or data processor) on the client's behalf.

This Policy covers (a) information collected through this website, and (b) the general practices we follow when operating systems for client businesses. For information about how a specific client handles your data, please refer to that client's own privacy policy.

2. Information We Collect

2.1 Through this website

This website is informational and does not require registration or accounts. We may collect:

• Standard server logs (IP address, browser type, pages visited, timestamps), retained for security and operational diagnostics for up to 90 days.
• Information you voluntarily send us via email (name, email address, message content).

2.2 Through systems we operate for clients

When operating intake, messaging or workflow systems on behalf of a client, we may process on the client's behalf:

• Identifying information (name, phone number, address, identifiers required by the client's operations).
• Transactional and operational data specific to the service the client provides.
• Communication content sent through messaging platforms (WhatsApp, Telegram, SMS).
• Documents and files submitted as part of the client's operational workflow.

All data processed in this capacity is owned and controlled by the client business, not by Niamh. We process it strictly under the terms of our service agreement with that client.

3. How We Use Information

We use information only for the following purposes:

• Operating and maintaining the systems we have agreed to provide to client businesses.
• Responding to inquiries sent directly to Niamh.
• Diagnosing technical issues and maintaining system security.
• Complying with applicable legal obligations.

We do not sell personal information. We do not use personal information for advertising. We do not use client data to train artificial intelligence models intended for external use. Fine-tuning of internal models is limited to the exclusive operational benefit of the specific client whose data was used, and never contributes to broader AI systems.

4. Data Storage and Security

Personal data processed by Niamh is stored on infrastructure under our direct operational control, with continuous encrypted backups to redundant secondary storage. We apply industry-standard security practices including encryption in transit (TLS), access controls, audit logging, and regular backup verification.

No system is perfectly secure. In the event of a confirmed data breach affecting personal information, we will notify the relevant client business without undue delay so that the client may fulfill its own notification obligations to affected individuals and authorities.

5. Data Retention

Retention periods are defined by the service agreement with each client and by applicable law. For records governed by Mexican commercial law (Article 46 of the Código de Comercio), records are retained for ten (10) years. For other data, retention periods are documented in the operational specifications of each client engagement.

6. Sharing of Information

Niamh does not share personal information with third parties, except:

• With the client business on whose behalf the data was collected.
• With service providers strictly necessary to operate our infrastructure (cloud platforms, messaging APIs), under contractual confidentiality.
• When required by valid legal process.

7. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict the processing of your personal information. Because Niamh typically acts as a service provider to client businesses, the most effective way to exercise these rights is to contact the client business with which you have a relationship directly.

8. International Data Transfers

Niamh is incorporated in the United States and provides services to client businesses located primarily in Mexico. Personal information may be transferred across these jurisdictions in the ordinary course of providing services. We rely on contractual safeguards and the legal frameworks of both jurisdictions to protect such transfers.

9. Children

Our services are directed to businesses and adult individuals. We do not knowingly collect personal information from children under 13 (in the United States) or under the equivalent age threshold under applicable local law.

10. Changes to this Policy

We may update this Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated to client businesses through our existing service channels.

Niamh Ventures presta servicios de infraestructura a otras empresas, no directamente a consumidores. Cuando usted interactúa con un sistema operado por Niamh en nombre de un cliente — por ejemplo, un sistema de mensajería, formulario de captura o servicio de notificación que opera bajo la marca de ese cliente — la empresa cliente es la responsable del tratamiento de los datos y el punto de contacto principal. Niamh actúa como prestador de servicios (encargado del tratamiento) en nombre del cliente.

2. Información que Recopilamos

2.1 A través de este sitio web

Este sitio es informativo. Podemos recopilar:

• Registros estándar del servidor (dirección IP, tipo de navegador, páginas visitadas, marcas temporales), conservados hasta 90 días por motivos de seguridad operativa.
• Información que usted nos envía voluntariamente por correo electrónico.

2.2 A través de sistemas operados para clientes

Al operar sistemas para un cliente, podemos procesar en su nombre:

• Información de identificación (nombre, teléfono, dirección, identificadores requeridos por la operación del cliente).
• Datos transaccionales y operativos propios del servicio que presta el cliente.
• Contenido de comunicaciones enviadas por plataformas de mensajería (WhatsApp, Telegram, SMS).
• Documentos y archivos enviados como parte del flujo operativo del cliente.

Todos los datos procesados bajo esta capacidad son propiedad y están bajo el control de la empresa cliente, no de Niamh.

3. Uso de la Información

Utilizamos la información únicamente para:

• Operar y mantener los sistemas acordados con las empresas clientes.
• Responder consultas dirigidas directamente a Niamh.
• Diagnosticar incidencias técnicas y mantener la seguridad de los sistemas.
• Cumplir obligaciones legales aplicables.

No vendemos información personal, no la utilizamos para publicidad, ni la usamos para entrenar modelos de inteligencia artificial destinados a uso externo.

4. Almacenamiento y Seguridad

Los datos personales procesados por Niamh se almacenan en infraestructura bajo nuestro control operativo directo, con respaldos cifrados continuos en almacenamiento redundante. Aplicamos prácticas de seguridad estándar de la industria, incluyendo cifrado en tránsito (TLS), controles de acceso, registro de auditoría y verificación periódica de respaldos.

5. Retención de Datos

Los periodos de retención están definidos por el contrato con cada cliente y por la legislación aplicable. Para registros sujetos al derecho mercantil mexicano (artículo 46 del Código de Comercio), los registros se conservan durante diez (10) años.

6. Compartición de Información

Niamh no comparte información personal con terceros, excepto:

• Con la empresa cliente en cuyo nombre fue recopilada.
• Con proveedores estrictamente necesarios para operar la infraestructura, bajo confidencialidad contractual.
• Cuando lo requiera un proceso legal válido.

7. Derechos del Titular

Conforme a la legislación aplicable en su jurisdicción, usted puede tener derechos de acceso, rectificación, cancelación u oposición (derechos ARCO en México) sobre sus datos personales. Dado que Niamh actúa como prestador de servicios, la forma más efectiva de ejercer estos derechos es contactar directamente a la empresa cliente con la que usted tiene relación.

8. Transferencias Internacionales

Niamh está constituida en Estados Unidos y presta servicios a clientes ubicados principalmente en México. La información personal puede transferirse entre estas jurisdicciones en el curso ordinario de la prestación del servicio, bajo salvaguardas contractuales y los marcos legales aplicables.

9. Cambios al Aviso

Podemos actualizar este Aviso periódicamente. Las modificaciones se reflejarán en la fecha "Última actualización" en la parte superior. Cambios materiales se comunicarán a las empresas clientes a través de los canales de servicio establecidos.
